Guardian of the Person and of the Estate

A guardian of the person makes personal and medical decisions, while a guardian of the estate manages finances and property.

Guardian of the Person

A Guardian of the Person is responsible for the individual’s personal well-being and day-to-day care. This may include:

  • Making medical and health care decisions
  • Determining living arrangements
  • Ensuring proper nutrition, hygiene, and safety
  • Coordinating care and services

The guardian must act in the individual’s best interest and, when possible, consider their preferences and values.

Guardian of the Estate (Financial Guardian)

A Guardian of the Estate manages the individual’s financial affairs and assets. Responsibilities typically include:

  • Paying bills and managing income
  • Protecting and investing assets
  • Handling benefits such as Social Security or pensions
  • Filing taxes and maintaining financial records

The guardian must act prudently and is required to file regular accountings with the court to ensure transparency and prevent misuse of funds.
