Guardianship limits a person’s rights, so it should be used only when less restrictive alternatives are not enough.

Alternatives to Guardianship

Guardianship can limit a person’s rights and should be used only when less restrictive alternatives are insufficient. Some examples are as follows:

  • Financial Power of Attorney: Lets a trusted agent handle finances on someone’s behalf. In Pennsylvania, a durable power of attorney can remain effective after incapacity, but it must be signed while the person still has capacity.
  • Health Care Power of Attorney and Living Will: Lets a person name a health care agent to make medical decisions if they become unable to do so, and may also express end-of-life wishes in a living will.
  • Health Care Representative: Pennsylvania law allows certain family members or friends to make health care decisions for an incapacitated person in appropriate circumstances.
  • Representative Payee: For Social Security or SSI benefits, the agency can appoint someone to manage those payments without a court guardianship. The same concept may apply to VA benefits in the appropriate agency process.
  • Supported Decision-Making: Allows a person to keep decision-making authority while receiving help from trusted supporters to understand options and communicate choices.
  • Trusts and Special Needs Trusts: May help manage assets while preserving access to certain public benefits.
  • ABLE Accounts: May help eligible individuals save and spend funds without jeopardizing benefits, subject to program rules.
  • Co-Signatory or Account Support Arrangements: Can help with routine bill-paying or account management in limited situations.

When alternatives truly aren’t enough, guardianship may be appropriate if it is necessary to protect the person and no less restrictive option will work.
